Novice Drivers, Penalty Points & Police Sanctions
Novice Driver Scheme (Beginnersrijbewijs)
- Duration: 5 years (7 years if obtained before age 18).
- Penalty Points: A novice driver who accumulates 2 points for serious offenses (tailgating, speeding by >30 km/h or >40 km/h on motorways, causing injury/death) must surrender their licence and retake theory/practical exams at CBR.
Accompanied Driving: 2toDrive
- Theory exam from age 16.
- Driving lessons from age 16.5.
- Practical CBR exam from age 17.
- Requirements for Coaches (Begeleiders):
- Must be at least 27 years old.
- Must have held Category B licence for at least 5 continuous years.
- May not have had a disqualification or alcohol course in the past 4 years.
Police Sanctions
- Driving Ban (Rijverbod): Up to 24 hours. Applies to all vehicles, including bicycles!
- Confiscation (Invordering): Driving licence confiscated on the spot by police if speeding by 50 km/h or more (or 30 km/h at roadworks) or if BAC > 1.3‰ (0.8‰ for novice).
- Disqualification (Ontzegging van de rijbevoegdheid - OBM): Imposed exclusively by a court judge. Driving during an OBM is a crime punished with imprisonment under Article 9 WVW.
Essential Statutory Rules (RVV 1990)
- Novice driver status: 5 years (7 years if passed before age 18 under 2toDrive).
- Penalty point system: 2 registered serious violations lead to mandatory driver fitness investigation at CBR.
- 2toDrive coaches: must be at least 27 years old and hold category B for at least 5 continuous years.
- Rijverbod (max 24h) vs Invordering (on the spot) vs Ontzegging van de rijbevoegdheid (judge).
A driving ban (rijverbod, max 24 hours) imposed on the spot by police applies to ALL vehicles, including riding a bicycle!
