Absolute Legal Responsibility (Article 5 WVW 1994)

Even in cars equipped with full Autopilot or lane-centering systems:

  • SAE Level 1 and Level 2: Current production cars provide driver assistance, not autonomous driving.
  • Statutory Principle: You as the human driver are legally responsible for every meter traveled. If your car exceeds the speed limit because ISA failed to read a temporary roadworks sign, you pay the fine.
  • If ACC fails to brake behind stationary traffic and causes a crash, you are legally liable for damages and criminal prosecution under Article 5 / Article 6 WVW.

Sensor Degradation & Limitations

  1. Camera Blindness: Covered by ice, snow, dead insects, or blinded by direct low evening sunlight.
  2. Radar Failure: Radar units behind the front grille become disabled when packed with slush or heavy snow.
  3. Road Markings: LKA cannot steer on snow-covered roads, unpainted rural lanes, or yellow construction lines.

Essential Statutory Rules (RVV 1990)

  • Modern passenger cars operate at SAE Level 1 or 2 automation (driver assistance, not autonomous driving).
  • The driver remains 100% legally responsible for vehicle speed, lane keeping, and collision avoidance at all times (Article 5 WVW).
  • Heavy spray, dirt, ice, or blinding sun can blind cameras and radar sensors.
  • Phantom braking: radar may mistakenly detect overhead bridge shadows or metal plates as obstacles.
CBR Exam Insight & Common Pitfall

An ADAS malfunction can NEVER be used as a legal defense for a speeding fine or collision in the Netherlands!
