Foundations of Dutch Road Traffic Law

Traffic in the Netherlands is governed by two foundational acts:

  1. Wegenverkeerswet 1994 (WVW 1994): The formal parliamentary law establishing criminal offenses, driving licences, alcohol limits, and liability.
  2. Reglement Verkeersregels en Verkeerstekens 1990 (RVV 1990): The administrative decree establishing detailed rules of the road, priority, road signs, and markings.

Article 5, WVW 1994: The Catch-All Article (Kapstokartikel)

“It is prohibited for anyone to behave in such a manner that danger on the road is caused or can be caused, or that traffic on the road is obstructed or can be obstructed.”

  • Scope: Applies to everyone on a public road—drivers, passengers, cyclists, and pedestrians.
  • Usage: Used by police when reckless behavior is not explicitly defined in an RVV rule (e.g. driving with a windshield covered in ice, texting while drifting between lanes, or driving aggressively).

Article 7, WVW 1994: Leaving the Scene of an Accident

  • Leaving the scene after being involved in an accident where injury or damage occurred is a criminal offence (misdrijf).
  • The 12-Hour Self-Report Rule: If you scrape a parked car and cannot locate the owner, you will avoid criminal prosecution under Article 7 only if you voluntarily report the incident to the police within 12 hours of the accident.

Essential Statutory Rules (RVV 1990)

  • Article 5 WVW (Kapstokartikel): It is prohibited for anyone to cause danger or obstruction on the public road.
  • Article 5 applies to all persons (drivers, pedestrians, passengers) on public roads.
  • Article 7 WVW: Leaving the scene of an accident with damage or injury is a serious criminal offence (misdrijf).
  • The 12-hour rule: Reporting damage to the police voluntarily within 12 hours avoids prosecution for leaving the scene.
